REPORT OF THE PLANNING COMMITTEE MEETING

 Wednesday 28 September 2011 at 7.30pm

 In the Council Chamber, 66 Dunstable Street, Ampthill.

Present: Councillors Mrs M Wright (Chairman), Mrs S Bacon, M Blair, P Duckett (Vice Chairman), Mrs P Foster, Mrs S Hinkin, Mrs M Wilson and the Deputy Town Clerk.

Also present: Councillor J Bingham, R Tebbutt (until 8.15pm) and 10 members of the public.

  1. 1.                  Apologies and Substitutions

None.

  1. 2.                  Period of Public Participation

Mrs Lisa White of Wagstaff Way registered to speak against the Waste Transfer Station, Station Road application and voiced concerns regarding odour and noise.

A petition had been signed by 200 local residents. The issues raised were a strong unpleasant odour from the site, potential air pollution, noise, deliveries and hours of operation taking place late evening and at weekends.

The members of the public were informed that the Town Council had been in contact with Central Bedfordshire planning officers to ensure that the concerns of local residents were being addressed.

Central Beds had stated that the Environment Agency have given the site operators a period of time to draw up an action plan for management of the site and a response was due mid October. In the meantime some residents had been asked to keep a diary identifying when the odour emitting from the site is particularly at its worst.

The residents were advised to make sure that they had sent their letters of concern to the Planning Authority and to take the opportunity to address that Council’s planning meeting when this application comes up for consideration.

Standing orders were suspended at 7.40pm to allow for the following information:

·         Only 2 houses in Grange Road received letters of consultation but following contact by Mrs White and her fellow residents the houses in Grange Road now have the relevant contact details for CBC to make their views known.

·         It is particularly the green waste at the site that is causing the bad smell.

·         So far only 18 responses had been submitted to CBC so Mrs White was advised to ensure that their petition is sent to CBC.

·         Cllr Blair advised that for the sake of fairness he would be meeting the operators of the site which was understood by the residents.

Standing orders were resumed at 7.46pm.

The Chairman thanked Mrs White for attending the meeting and making a good presentation on behalf of the residents being affected by this site. The members of the public then left the meeting.

  1. 3.                  Declarations of Personal or Prejudicial Interest

Cllr Mrs P Foster declared a personal and prejudicial interest in the Katherine’s Garden application as she will have a future financial interest in her mother’s property situated in the immediate vicinity of the application site. Therefore Cllr Foster left the room during consideration of the application.

Cllr P Duckett declared a personal interest in the 1 Alameda Road application as he is known personally to the applicant.

Cllr Mrs M Wright had declared her personal and prejudicial interest in the 14 Hazelwood Lane application as her husband was the applicant’s architect; therefore she took no part in the decision on that application. Cllr Wright also declared her personal and prejudicial interest in the Ampthill Park Hub as her husband supplied a couple of the plans for the application and therefore took no part in the decision on that application.

Cllr M Blair declared a personal interest in the Land at Station Road/Bypass Road for 37 dwellings as one of the companies involved in the scheme is his future pension provider.

  1. 4.                  Neighbourhood Planning

This item was brought forward on the agenda so Cllr Tebbutt could explain his request for the item to be considered.

The members of the planning meeting were asked to consider applying to Central Bedfordshire Council for inclusion in a grant to develop an Ampthill Town Centre plan under the localism legislation. The application must be made by letter outlining the Town Council’s reasons for applying by 4th November 2011 or by March 2012. A document entitled ‘Neighbourhood Planning Front Runners’ prepared by the Department for Communities and Local Government had been circulated with the agenda giving further information for members.

It was reported that Central Beds Council is being used as one of a number of pilot areas for this scheme, having been awarded a grant for a Neighbourhood Plan. The area already chosen is Caddington and Slip End.

With Ampthill’s increasing population and problems with parking and future sustainability it was considered that a plan for Ampthill would be a positive step forward and could tie in with the new homes bonus scheme.

Recommended: That this Council’s interest in an Ampthill Town Centre plan be raised with Central Bedfordshire Council as part of the discussion with the planning officers at our next meeting.

14A Woburn St. Variation of Condition: to planning permission MB/06/01251 change to condition 1 to allow premises to operate for longer hours. Change to condition 3 to allow a fully operating restaurant with A3/A5 use class.

·         The Town Council is opposed to the premises operating for longer hours. Any extension in hours will result in litter and noise nuisance from persons going to the premises late evening/late at night and then making their way back into the town centre to return to local pubs or sit in the market square until early hours making noise.

·         Ampthill does not want a return of this late night nuisance behaviour in the town centre. It is unacceptable to expect nearby residents and shop owners to suffer the general nuisance that this proposed variation will bring.

·         There is also a lack of parking for this premise and its situation at the brow of the hill makes parking outside the premises hazardous for other road users.

  1. 9.         Appeal Decisions       

·         Appeal Dismissed. 49 Bedford Street. Loft conversion with “velux” style roof lights front and rear and a dormer to the side. The Inspector concluded that the proposal would harm the Conservation Area as the jarring and uncomfortable feature would harm the dramatic and striking view down the hill from the northern entrance to the town.

·         Appeal Allowed and Enforcement Notice quashed. Land at Oak Barn, Little Park Farm, Station Road. Construction of a detached building and an area of hardstanding.

Recommended: That the above be noted.

  1. 10.       Planning Training Event

Councillors Sue Hinkin and Steve Whittaker attended the training event at Central Beds Council on 14th September 2011. Workshops consisted of the planning application process, planning obligations and planning enforcement.

Sally Chapman and Mark Saccoccio, CBC officers have offered to come and speak to the Town Council so therefore, members were requested to consider which topics they would like to discuss with a view to the Officers attending the next planning meeting.

Recommended: That the CBC Officers be invited to the town council offices on Wednesday 26th October for a 6.45pm start, before Planning at 7.45pm, to broadly speak and discuss Section 106, Neighbourhood Plans and the New Homes Bonus Scheme.          

  1. 11.       Ampthill & Flitwick Local Area Transport Plan - CBC

Councillor Mrs Foster gave a brief feedback on the above meeting held on 26th September which provided the opportunity to meet with Central Beds Council regarding transport infrastructure and service provision across the authority.

Although the event was not that well attended it was an interesting meeting. There is funding available of £1.4million for the whole of Central Bedfordshire to improve transport. The main focus appeared to concentrate on improving and promoting cycling and public transport. There is not enough funding to do bigger projects like additional parking but small improvements such as improved signage and live bus time tables could be sought for Ampthill.

Central Beds Council planning officers are happy to come and talk to individual town and parish councils to discuss the plan further. Formal public consultation is due to take place from October.
